Welcome to Kemet Money. By accessing or using our services, you agree to these Terms and Conditions of Use ("TCU"), which constitute a legally binding agreement between SOLUTIONS KEMET (hereinafter "Kemet Money") and you, the user. Please read these terms carefully. If you do not accept these TCU, you must not use our services.
- DEFINITIONS • "Kemet Money": the trade name of the company SOLUTIONS KEMET, incorporated in Quebec, operating the money transfer platform. • "User": any individual using the Kemet Money platform. • "Service": all money transfer and account management features offered via the mobile app or website. • "Transaction": a money transfer operation made via Kemet Money. • "Beneficiary": a person receiving the funds from a transaction. • "Service Fees": the amount charged by Kemet Money in exchange for the use of the Service. • "Payment Instrument": debit card, credit card, or bank account used to fund a transaction.
- PURPOSE These TCU define the conditions under which users may access and use the services offered by Kemet Money. They comply with the principles of the Civil Code of Quebec, particularly articles 1435 and 1437 regarding abusive clauses. Any unreasonable or bad-faith clause may be declared null.
- ACCEPTANCE OF THE CONTRACT Use of the Service constitutes full and express acceptance of these TCU as well as associated policies (Privacy Policy, Cookie Policy, etc.).
- ELIGIBILITY REQUIREMENTS You must be at least 18 years old, reside in a country served by Kemet Money, and have the legal capacity to enter into a binding contract.
- ACCOUNT CREATION You must provide accurate, complete, and up-to-date information. You are responsible for keeping your login credentials confidential and for all activity related to your account. Providing false information may result in suspension or deletion of the account.
- AUTHORIZED USE The Service is intended for personal, lawful, and non-commercial use unless otherwise authorized in writing. It is prohibited to use our services for activities such as: money laundering, terrorist financing, gambling, pornography, weapons, drugs, cryptocurrency, phishing, or any fraudulent or illegal activity.
- IDENTIFICATION AND VERIFICATION (KYC) In accordance with the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA), Kemet Money must collect and verify certain information (ID documents, proof of address, source of funds, etc.). Access to services may be suspended for non-compliance.
- FEES, EXCHANGE RATES, AND MARGINS All service fees are communicated before the confirmation of a transaction. Exchange rates may include a margin. Kemet Money may charge a commission on currency conversion. Additional fees may be charged by third-party financial institutions.
- INITIATION AND PROCESSING OF TRANSACTIONS Transactions are processed once all information has been verified and payment authorization received. Once initiated, transactions are irrevocable unless cancellation complies with the terms of Article 16.
- RECEIPT OF FUNDS BY THE BENEFICIARY The beneficiary may receive funds through available methods by country (bank deposit, mobile money, cash pickup). They must present the required documents to collect the funds.
- ERRORS, DELAYS, CANCELLATIONS, AND REFUNDS In case of error or unauthorized transaction, you must contact us within 180 days. If the error is attributable to us, a refund will be issued. No refund will be made if the funds have already been delivered to the beneficiary unless a proven error has occurred. The standard processing time for refunds is 3 to 7 business days from the validation of the case.
- GUARANTEED DELIVERY PROMISE If funds are not available on the date stated on your transaction receipt, you may request a full refund of the service fees, subject to a formal request through customer support.
- SERVICE LIMITATIONS AND CONTROLS Transfer limits, geographic restrictions, or payment method restrictions may apply. Kemet Money may block suspicious transactions or those subject to regulatory requirements.
- ACCOUNT SECURITY You must keep your credentials confidential. Kemet Money is not liable for any fraudulent account use resulting from your negligence.
- ACCOUNT TERMINATION Kemet Money may suspend or close an account in case of TCU breach, prolonged inactivity, suspected fraud, or regulatory request. Users may close their account at any time via email.
- RIGHT OF WITHDRAWAL AND CANCELLATION You may cancel a transaction as long as the funds have not yet been delivered. If accepted, fees will be refunded partially or fully depending on the case. Late cancellation requests may be denied.
- DATA COLLECTION AND PROTECTION Collected data is used to deliver the Service, comply with legal obligations, and improve user experience. Data is processed in accordance with our Privacy Policy. Kemet Money may share data with competent authorities.
- ELECTRONIC COMMUNICATIONS You agree to receive all communications, notifications, and documents (invoices, alerts, TCU updates) in electronic format.
- DISPUTE RESOLUTION, COMPLAINTS, AND ARBITRATION In case of dispute, the parties agree to seek an amicable resolution. Kemet Money will acknowledge receipt of any customer complaint within 48 business hours and provide a response within 7 calendar days. Complaints must be sent to support@kemetmoney.com, including full name, phone number, email address, transaction date, and specific reason for the complaint. If resolution fails, the matter will be submitted to confidential arbitration under the rules of the Arbitration Institute of Quebec. You expressly waive any right to class actions and agree not to initiate or participate in class action, consolidated claims, or mass arbitration without prior mutual agreement. Arbitration costs are shared equally unless otherwise decided by the tribunal.
- LIMITED LIABILITY Kemet Money’s liability is limited to 1,000 CAD per incident. Kemet Money shall not be held liable for indirect damages, loss of profit, or force majeure (internet outages, conflicts, natural disasters, etc.).
- INTELLECTUAL PROPERTY Kemet Money owns the logos, texts, images, source codes, and trademarks. Any reproduction or extraction without permission is prohibited.
- TCU AMENDMENTS Kemet Money may amend these TCU with 30 days’ notice. Changes will be notified via email or app. You may reject the amendment without penalty by ceasing to use the Service and notifying us in writing within 30 days of the notice. Continued use after this period constitutes acceptance of the new terms.
- APPLICABLE LAW AND JURISDICTION These TCU are governed by the laws of the Province of Quebec. Any dispute shall be submitted to the courts of the judicial district of Shawinigan.
- ENTIRETY AND SEVERABILITY These TCU constitute the entire agreement between the parties. If any provision is found to be invalid, the remaining provisions shall remain in force.
